Different phases of duty of care by financial enterprises
Because of the social function that financial enterprises fulfill and the information asymmetry that exists between financial enterprises and their clients, these enterprises have a special duty of care. Frank ’t Hart studies three phases into which duty of care can be subdivided. these are product development, distribution and contact with the client. He also formulates a fourth phase, which consists of supervision of compliance with the duty of care.
